Noonsilk Online Shop Terms and Conditions

1. Definitions

  • Business days – Monday through Friday excluding Polish public holidays.
  • Account – free-of-charge Shop function allowing Buyer registration, governed by separate terms.
  • Consumer – entity as defined in Directive 2011/83/EU of the European Parliament and Council.
  • Buyer – any entity purchasing from the Shop with habitual EU residence.
  • Terms and Conditions – these governing terms.
  • Shop – Noonsilk online shop at https://www.noonsilk.com directed to Buyers.
  • Seller – MARTA MARIA BANACH, trading as "Noon Marta Banach," registered in Poland's Central Register, NIP 8393080128, REGON 387628460, ul. Ludwika Solskiego 12/1, 76-200 Słupsk.

Standard telecommunications rates apply; international calls may incur higher charges per operator tariffs.

3. Technical Requirements

  1. Required: Internet-connected device with web browser supporting cookies and JavaScript.
  2. Active email account required for Shop orders.

4. Purchasing at the Shop

  1. Displayed prices are total prices including goods and delivery costs.
  2. Buyer adds items to cart, selects delivery/payment methods, provides necessary data.
  3. Order placement confirms contract conclusion between Buyer and Seller.
  4. Seller provides Consumer with contract confirmation on durable medium at delivery.
  5. Buyers may register for an Account or purchase without registration.

5. Payments

Available payment methods:

  • Bank transfer
  • Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro
  • Paynow platform
  • Card/cash upon personal collection

Advance payment required within 1 Business day from contract conclusion date. Electronic invoices accepted; Buyer may withdraw consent. Some payment methods available only immediately after order placement.

6. Performing Orders

  1. Seller delivers defect-free goods.
  2. Fulfillment timeframe specified at Shop.
  3. Orders commence after payment receipt (if advance payment chosen).
  4. Multiple-item orders fulfilled according to longest individual item timeframe.
  5. Delivery countries: Poland, Germany, Ireland, United Kingdom.
  6. Delivery via delivery company or Paczkomaty InPost.
  7. Personal collection available during business hours.
  8. Personal collection goods ready by indicated fulfillment date.

7. Right of Withdrawal from Contract

  1. Consumers may withdraw within 14 days without giving any reason, subject to Section 8.
  2. Period expires 14 days from physical possession acquisition.
  3. Consumer must notify Seller using contact details in Section 2 via unequivocal statement.
  4. Model withdrawal form available but optional.
  5. Communication sent before deadline satisfies requirement.
  6. All payments reimbursed including delivery costs (except supplementary charges from non-standard delivery selection), within 14 days from withdrawal notification.
  7. Reimbursement via original payment method unless Consumer agreed otherwise; no fees charged.
  8. Seller may withhold reimbursement until goods received or return evidence provided.
  9. Goods returned to: ul. Ludwika Solskiego 12/1, 76-200 Słupsk, Poland within 14 days of withdrawal notice.
  10. Consumer bears direct return shipping costs.
  11. Consumer liable only for diminished value from handling beyond necessary inspection.
  12. For non-postal goods, Consumer bears return costs; estimated cost disclosed in product description or order process.
  13. Payment card refunds processed to associated bank account.

8. Exceptions from Right of Withdrawal

Consumer cannot withdraw for:

  • Goods made to specifications or clearly personalized
  • Perishable or rapidly deteriorating goods
  • Sealed hygiene products unsealed after delivery
  • Goods inseparably mixed with other items post-delivery
  • Unsealed audio/video recordings or computer software
  • Newspapers, periodicals, magazines (except subscriptions)
  • Goods/services with prices dependent on uncontrollable financial market fluctuations during withdrawal period

9. Complaints

  1. Defective goods may be complained about.
  2. Seller responsible for defects appearing within 2 years from delivery date.
  3. Complaint options: price reduction, contract withdrawal (substantial defects), replacement, or defect removal.
  4. Direct complaints to Section 2 contact details.
  5. Delivery for complaint examination required at ul. Ludwika Solskiego 12/1, 76-200 Słupsk, Poland (Consumer's expense covered by Seller).
  6. Additional guarantees disclosed in product descriptions.
  7. Shop functionality complaints submitted electronically to Section 2 email.
  8. Seller reviews complaints within 14 days.

  • European Consumer Centre assistance (EEC-Net)
  • Online Dispute Resolution (ODR)
  • Regional Trade Inspector mediation
  • Permanent consumer arbitration courts
  • Municipal or poviat consumer advocates

10. Personal Data

  1. Data controller: Seller. Detailed processing information in Privacy Policy per GDPR.
  2. Order fulfillment processing basis: contract performance, legal accounting obligations, legitimate interests.
  3. Data provision voluntary but necessary for contract conclusion; non-provision prevents ordering.
  4. Data processed until: contract expiration, legal obligations cease, claims prescribe, or objection accepted.
  5. Consumers may request: access, rectification, deletion, processing restriction, data transfer, and object to processing based on legitimate interests.
  6. Contact Seller (Section 2) to exercise rights.
  7. Illegal processing complaints lodge with Personal Data Protection Office President.

11. Restrictions

  1. Illegal content prohibited.
  2. Each Shop order requires separate contract and Terms acceptance.
  3. Contracts governed by Polish law; Consumer protections maintained per mandatory provisions.
  4. Contracts concluded in English.
  5. Terms do not waive/restrict Consumer legal rights.

12. Provisions for Non-Consumer Buyers

  1. Non-Consumers lack withdrawal rights.
  2. Seller liability excluded within legal limits.
  3. Disputes submitted to Seller's registered office court.
